In early December, the Colorado Supreme Court ruled to remove Mr. Trump from the primary election ballot in this state.

`Sedition` is a very rarely used term in the US constitution.

Mr. Trump and his associates are expected to appeal to the US Supreme Court, which has the authority to annul the above decisions.

When does the `rebellion` clause apply?

The Colorado Supreme Court’s ruling marked the first time in American history that a candidate was considered ineligible to run for president according to constitutional provisions.

The `sedition` clause is located in Section 3, 14th Amendment. Accordingly, anyone who has taken an oath to defend the constitution but then participates in `an insurrection against the constitution`

The 14th Amendment was ratified in 1868 with the purpose of guaranteeing civil rights to former slaves, and also to prevent former Confederate officials from regaining power as slaves.

Some legal scholars believe that the post-civil war clause is completely applicable to Mr. Trump.

Potential impact on the election

Colorado’s ruling only applies to the Republican primary election in the state on March 5, meaning Mr. Trump’s name may not appear on the ballot in that vote.

However, the Colorado Supreme Court temporarily stayed the ruling until January 4, giving the US Supreme Court time to decide whether to accept the case or not.

Colorado is considered one of the states that expressed support for incumbent President Joe Biden, giving Mr. Biden a double-digit victory in 2020. The last time the Republican party won

This state’s ruling could affect dozens of other lawsuits taking place across the United States.

For his part, Mr. Trump did not directly mention this issue during a campaign event on December 19 in Iowa.

Instead, members of his team sent out an email with the following content: `Democratic leaders are panicking before former President Donald Trump’s overwhelming position. They have lost faith.

At the same time, Mr. Trump’s lawyers argued that the 14th Amendment did not apply to the presidency.

Furthermore, Mr. Donald Trump’s statements to his support group that day in Washington are protected under freedom of speech.
